Overview of the 8th Street Collision. When a pedestrian is hit within a marked crosswalk, investigators frequently cite the Crosswalk Right-of-Way Law. This law mandates that drivers must yield to pedestrians legally present in a crosswalk. In this instance, officers will assess whether the driver had sufficient time and visibility to stop while the pedestrian was crossing 8th Street. As potential driver behavior remains under investigation, authorities might also apply the Failure to Exercise Due Care Law.
