(Visalia, CA) On Friday evening, October 31, an individual operating an electric wheelchair was fatally hit in a collision on Mooney Boulevard, as per the Visalia Police Department. The officers arrived at the scene around 6:00 p.m. regarding an incident involving a vehicle and a pedestrian at the junction of Mooney Boulevard and Feemster Avenue. Upon their arrival, the officers discovered that the victim had been struck during the act of crossing the road using a mobility chair. Subsequently, when paramedics arrived on the scene, they promptly transported the victim to Kaweah Health Medical Center, where unfortunately, they succumbed to their injuries. The driver involved stayed at the location and worked with the police. Officials stated that the investigation is still active and have not disclosed the victim’s identity until family members have been informed. Summary of the Mooney Boulevard Crash. When a pedestrian using a mobility aid is hit, investigators frequently start by examining the Pedestrian Right-of-Way Law. This law mandates that drivers give way to pedestrians, including individuals in wheelchairs, while they are crossing the street at both marked and unmarked crosswalks. Not yielding or being too careless can lead to serious or deadly injuries. If speed or visibility were factors, the Basic Speed Law might also apply. Drivers must travel at a speed that is safe for the existing traffic and lighting conditions, especially close to intersections where pedestrians are common. In certain instances, the Due Care Law may be relevant even when a pedestrian is crossing outside a marked crosswalk.
